Welcome to SwiftSolvency, a service provided by TrazTech Solutions, LLC ("TrazTech", "we", "us", "our"). By accessing or using our email marketing software (the "Service"), you agree to be bound by these terms and conditions ("Terms"). Please review them carefully before using the Service.
You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent and warrant that you are legally qualified to enter into a binding contract and that you agree to comply with all local, state, national, and international laws and regulations.
The Service is intended for commercial use, particularly related to email marketing. You agree to use the Service only for lawful purposes and not to use it in a way that infringes the rights of others, disrupts or damages the Service or its use by others, or violates any applicable laws or regulations. You agree that you have obtained permission to communicate with any contacts you launch campaigns with in accordance with local law.
When you create an account with us, you agree to provide accurate, complete, and current information as requested during the registration process. You are solely responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage the use of "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols).
The Service and its original content, features, and functionality are and will remain the exclusive property of TrazTech Solutions, LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TrazTech Solutions, LLC.
All fees are stated clearly at the time of purchase and are billed in advance. Fees are non-refundable except in cases of proven service failure or breach of contract by us. Subscription plans may be cancelled by you at any time, with cancellation taking effect at the end of the billing period.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
You agree to defend, indemnify, and hold harmless TrazTech, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or from or in connection with any breach by you of these Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
